Terms of Service
These terms govern use of Lead Commander, operated by The Meliora Group LLC, an Ohio limited liability company trading as Agency Development Services ("we", "us"). By using Lead Commander you agree to them.
1. Who may use the service
Lead Commander is business software for insurance agencies and the licensed agents contracted under them. Accounts are created by an agency for named individuals. You may not share your sign-in with anyone else, and you are responsible for what happens under your account.
2. The agency's data is the agency's
Lead and customer records placed into Lead Commander remain the property of the agency that holds them. We process them to provide the service. We do not sell them and we do not use one agency's records for the benefit of another.
3. Connecting a mailbox
Connecting a Gmail or Google Workspace mailbox is optional. If you connect one, you
authorise Lead Commander to send messages as you, at your instruction. We request the
gmail.send scope only, which cannot read a mailbox. You may disconnect at any
time in My Email, or revoke access at your Google Account. See the
Privacy Policy.
4. Your responsibilities when contacting people
Compliance with contact law rests with you and your agency, not with us.
You are responsible for having a lawful basis to contact each person you contact, and for complying with all applicable law, including the Telephone Consumer Protection Act, the CAN-SPAM Act, federal and state Do Not Call rules, and the rules of any carrier or regulator you are subject to.
Lead Commander may display information such as Do Not Call status where we hold it. That display is a convenience and not advice, is not guaranteed to be complete or current, and does not transfer any compliance obligation to us.
You must not use Lead Commander to send unsolicited bulk mail, to send anything deceptive or unlawful, or to contact people you have no lawful basis to contact.
5. Acceptable use
You may not attempt to gain access to data belonging to another agency or agent, probe or disrupt the service, reverse engineer it, resell access without our written agreement, or use it to build a competing product.
6. Fees
Fees, seat charges and per-lead charges are as agreed with your agency or as shown in the application. Charges already incurred are not refundable on cancellation unless we agree otherwise in writing.
7. Availability
We work to keep Lead Commander available and correct, but it is provided as is, without warranty of any kind, express or implied, including any warranty of merchantability or fitness for a particular purpose. We do not warrant that it will be uninterrupted or error free.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business or lost data. Our total liability arising out of or relating to the service is limited to the amount you paid us for it in the twelve months before the claim arose.
9. Suspension and termination
We may suspend or terminate an account that breaches these terms, that puts the service or other customers at risk, or where required by law. You may stop using the service at any time; contact your agency administrator, or us, to close an account.
10. Changes
We may update these terms. Material changes will be notified to account holders by email before they take effect, and the date below will be updated.
11. Governing law
These terms are governed by the laws of the State of Ohio, United States, and the courts of Ohio have exclusive jurisdiction.
